Allahabad HC asks trial court to take up Krishna Janmabhoomi-Shahi Idgah land dispute case

The Allahabad High Court has directed the Mathura civil court to start hearing the Sri Krishna Janmabhoomi-Shahi Idgah land dispute case that was filed in September 2020.

The plea demanded the removal of the Shahi Idgah, a mosque that shares its walls with Shri Krishna Janmabhoomi temple in Mathura, and the transfer of 13.37-acre land to the deity. The Mathura lower court had refused to entertain the plea and registered it as a miscellaneous case on the ground that the plaintiffs were not residents of Mathura and therefore had no right to file the plea.

However, the Mathura district court held that the trial court had committed illegality and manifest error and directed the trial court to hear both parties and pass appropriate orders.

The High Court has directed the trial court to adjudicate the civil suit without being influenced by any observation or finding of the district judge. Both parties, the U.P. Sunni Central Waqf Board and Sree Krishna Virajman along with 10 others, are free to raise their contentions before the trial court.
